Welcome to Mercado Adonis (“Mercado Adonis,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of mercadoadonis.com (the “Website”) and your purchase of products from Mercado Adonis.

By using our Website or placing an order, you agree to these Terms. If you do not agree, please do not use the Website or place an order.

1. Products and Availability

Mercado Adonis offers fresh baked goods and related products for purchase in Puerto Rico.

We make reasonable efforts to ensure that product descriptions, photographs, prices, and availability are accurate. However, because our products are handmade and freshly prepared, individual products may vary slightly in appearance, size, shape, color, and texture.

Product availability may change without notice, and we reserve the right to modify or discontinue products at any time.

2. Orders

When you place an order through our Website, you are requesting to purchase the selected products.

An order is considered confirmed once Mercado Adonis has accepted the order and the required payment arrangements have been completed.

Please review your order carefully before submitting it. Customers are responsible for providing accurate contact, delivery, mailing, and pickup information.

Mercado Adonis is not responsible for delays or failed deliveries resulting from incorrect or incomplete information provided by the customer.

We reserve the right to refuse or cancel an order when reasonably necessary, including due to product availability, pricing errors, payment issues, suspected fraudulent activity, or circumstances beyond our reasonable control.

3. Payment

Mercado Adonis currently accepts:

• Cash, where available; and

• PayPal.

PayPal transactions are processed through PayPal and may be subject to PayPal's own terms and policies.

Prices displayed on the Website are in U.S. dollars (USD) unless otherwise stated.

Applicable taxes, delivery charges, mailing charges, or other applicable fees may be added to an order.

4. Delivery and Mailing

Mercado Adonis may offer local delivery and mailing/shipping within Puerto Rico for eligible products.

Delivery and shipping availability, fees, and estimated delivery times may vary by order and location.

Delivery and shipping times are estimates and are not guaranteed. Delays may occur due to weather, traffic, holidays, high order volume, carrier delays, incorrect addresses, or circumstances outside our reasonable control.

Customers are responsible for providing an accurate and complete delivery or mailing address.

Once an order has been transferred to a third-party shipping or postal provider, Mercado Adonis cannot control the carrier's handling or delivery timeline.

5. Local Pickup

Mercado Adonis may offer local pickup for eligible orders.

Pickup instructions, dates, and times will be provided to the customer.

Customers are responsible for collecting their orders within the designated pickup period. Because our products are fresh and perishable, Mercado Adonis cannot guarantee product quality when an order is not collected within the specified timeframe.

6. Fresh and Perishable Products

Many Mercado Adonis products are freshly prepared and may be perishable.

Customers are responsible for following any storage, refrigeration, handling, and consumption instructions provided with their order.

Once an order has been delivered or picked up, Mercado Adonis is not responsible for damage or deterioration resulting from improper storage, handling, transportation, or consumption.

7. Allergens and Dietary Information

IMPORTANT ALLERGEN DISCLAIMER:

Our products may contain or come into contact with common allergens, including milk, eggs, wheat, soy, peanuts, tree nuts, and other ingredients that may cause allergic reactions.

Because our products may be prepared in an environment where multiple ingredients are handled, we cannot guarantee that any product is completely free from allergens or cross-contact.

If you have a food allergy, intolerance, dietary restriction, or other food-related concern, please contact Mercado Adonis before placing your order to request available ingredient information.

Customers are responsible for determining whether a product is appropriate for their individual dietary needs. Mercado Adonis is not responsible for allergic reactions or other adverse effects resulting from the consumption of our products, to the extent permitted by applicable law.

8. Order Changes and Cancellations

Because many of our products are freshly prepared or made specifically for an order, changes and cancellations may not always be possible after an order has been confirmed or preparation has begun.

Please contact Mercado Adonis as soon as possible if you need to request a change or cancellation.

Custom, personalized, or made-to-order products may have additional restrictions and cannot be canceled once production has begun.

9. Refunds and Returns

Due to the nature of fresh and perishable food products, all sales are generally final.

No Refunds for Custom Orders

Custom, personalized, specialty, or made-to-order products are non-refundable and cannot be returned once the order has been confirmed or production has begun.

No Refunds for Opened Products

For health, safety, and quality reasons, Mercado Adonis does not accept returns or provide refunds for products that have been opened, partially consumed, altered, or improperly stored or handled after delivery or pickup.

Damaged, Incorrect, or Defective Orders

If you receive an incorrect, damaged, or materially defective order, please contact Mercado Adonis as soon as possible after receiving it.

We may request photographs and other information to evaluate the issue. After reviewing the circumstances, Mercado Adonis may, where appropriate, offer a replacement, refund, store credit, or another reasonable resolution.

Nothing in these Terms is intended to limit any consumer rights or remedies that cannot legally be waived under applicable law.

10. Website Use

You agree to use the Website only for lawful purposes.

You may not use the Website to:

• Engage in fraudulent or unlawful activity;

• Attempt to gain unauthorized access to our systems;

• Interfere with the Website's operation or security;

• Introduce viruses or other harmful material; or

• Misuse or reproduce Website content without permission.

Mercado Adonis reserves the right to restrict access to the Website when reasonably necessary to protect our business, customers, Website, or systems.

The Mercado Adonis name, logo, photographs, product images, text, graphics, designs, and other Website content belong to or are licensed to Mercado Adonis unless otherwise indicated.

Third-party services operate under their own terms and policies. Mercado Adonis is not responsible for the content, availability, security, or practices of third-party services.

Mercado Adonis is not responsible for delays, cancellations, or inability to fulfill an order caused by circumstances beyond our reasonable control, including severe weather, natural disasters, power outages, transportation disruptions, supply shortages, postal or carrier disruptions, or other unforeseen events.

When reasonably possible, we will communicate with affected customers and work toward an appropriate resolution.

16. Governing Law

These Terms are governed by the applicable laws of Puerto Rico.

Nothing in these Terms is intended to waive or limit any consumer rights that cannot legally be waived.

Your continued use of the Website after updated Terms are posted constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
